Terms of Service & User Agreement

By registering an account, making a purchase, or using any feature on Fashionistar, you warrant that you are at least 18 years of age (or the age of majority in your jurisdiction) and possess full legal capacity to enter into binding commercial contracts.

If you represent a corporate entity, tailoring house, or fashion brand, you warrant that you possess full corporate authority to bind that entity to these Terms.

• Client Obligations: You agree to provide accurate delivery addresses, valid payment instruments, and truthful measurement inputs. You agree to treat artisans and customer support representatives with professional dignity.
• Vendor & Designer Service Level Agreements (SLAs): Vetted vendors agree to: (a) maintain strict quality control matching product imagery; (b) acknowledge custom orders within 48 hours; (c) adhere to promised production timelines; (d) never solicit clients to conduct transactions off the platform ('Anti-Circumvention Rule').

When you commission a custom-tailored garment on Fashionistar, you enter into a tripartite contract with the Artisan and Fashionistar as Escrow Agent:

1. Binding Quote: The artisan's written quote in order chat constitutes a binding price and timeline commitment upon client acceptance.
2. Escrow Custody: 100% of order funds are deposited into Fashionistar Escrow prior to production commencement.
3. Milestone Tranches: Funds are disbursed in 4 sequential tranches (30% Deposit -> 50% Cutting -> 70% Progress -> 100% Delivery Approval).
4. Final Approval: Once delivery is physically confirmed, the client has 48 hours to inspect the garment before final milestone funds are disbursed. In the absence of an inspection response or dispute within 48 hours, delivery is deemed approved.

• Platform IP: All software, proprietary AI computer vision models, source code, logos, trademarks, and UI design elements are the exclusive intellectual property of AI-FASHIONISTARCLOTHINGS LIMITED.
• Designer IP: Vetted artisans retain full ownership and copyright of their original garment patterns and signature silhouettes.
• User Content License: By uploading product photos or style inspiration reviews, you grant Fashionistar a non-exclusive, royalty-free, worldwide license to host, display, and promote that content across our marketing channels.

The following actions are strictly prohibited and will result in immediate account termination, forfeiture of escrow claims, and potential civil prosecution:

• Initiating fraudulent payment chargebacks while retaining delivered merchandise.
• Contacting platform artisans to transact off-platform to evade escrow protections.
• Uploading counterfeit designer trademarks or selling substandard replica garments.
• Reverse-engineering or scraping our AI measurement computer vision APIs.

• Disclaimer of Warranties: Fashionistar operates as an AI-powered commerce and escrow platform. While we rigorously vet all artisans, we are not liable for direct fabric supplier shortages or carrier delivery delays caused by severe weather or customs inspections.
• Maximum Liability: To the maximum extent permitted by law, Fashionistar's total aggregate liability is strictly capped at the total amount paid by you for the specific order in dispute.
• Governing Law: These Terms shall be governed by and construed in accordance with the Laws of the Federal Republic of Nigeria.
• Arbitration: Any dispute arising from these Terms that cannot be resolved through mutual mediation within 30 days shall be settled by binding arbitration under the Arbitration and Mediation Act 2023 of Nigeria, with the arbitration seat in Lagos or Abuja.
